Henri Matisse’s 1905 work, Open Window, Colicure, is considered exemplary of the “fauvist” style: the description of this style of art as “fauvism”, which from the French translates into English as “wild beasts”, can be said to capture a certain wild and unbridled style that distinguishes these specific painters, of which Matisse is a part, as a distinctive approach. In the work in question, the raw animal quality that distinguishes this approach is shown in Matisse’s transformation of a mundane content matter, various plants and the scene seen from an open window, into something that is both vibrant and transgressive.

Exploring the Issues of P2P File Sharing and the Importance of the Value of Copyright

Introduction

            The overflow if information in the internet has caused both positive and negative effects on how the modern society intends to view the value of copyright and intellectual property. It could be analyzed that somehow, through the existence of this particular fact, drawing the line between merely sharing a file over the internet and specifically ‘plagiarizing it’ has become rather deem and unclear to many. Understandably, many people desire to share what they know about through the internet. Some own files such as movies and music which they also intend to share online. Some of these individuals do the said matter without any malice in mind. They simply share these files to their friends and to people who might be interested in seeing them without any desire of initiating crime-defined actions such as that of plagiarism. It is because of this reasoning that many individuals began to see plagiarism as a mere ‘thought’ and not a legal matter to consider. The unclear distinction of what is right and what is wrong has become rather a common matter in the field of modern internet operations. Notably, this is the reason why even though the legal sanctions are quite unclear in relation to this matter, several agencies and individuals the like resort to the rules of ethics. The right of ownership and intellectual property recognition is the relatively considered in relation to this particular issue. In the discussion that follows, understanding what constitutes proper from improper file sharing shall be given particular attention to. This shall be presented in relation to the desire of pointing out how file sharing in the internet should be viewed especially by those who consider it as a non-malicious act that should not be legally sanctioned. Clearing off the issues related to this matter is hoped to provide a clear distinction on how P2P file sharing should be viewed in line with the modern systems of sharing information through the internet.

What is P2P File Sharing?

            P2P is the abbreviation for the term peer to peer. Relatively, peer to peer sharing is coined as the term related to the manner by which one or two persons share specific files through networks hosted through the internet. For instance, in a social network, a personal video of a particular individual which he might like to share to his friends could be posted online for presentation. There are options to these video presentations with which they can be downloaded by the friends of the said individual and keep the said files as their personal copy. The process of peer to peer sharing however do not begin and end in social networking. There are some files that are passed on through download cue websites where users could actually look for specific files [maybe document, image, video or audio files of any kind] and be able to download the said items directly within minutes and keep the files as their own.

Among the files passed on through these download nooks in the web are movies and music renditions by artists in the entertainment industry. There are instances that these files, when shared and downloaded are maliciously treated in a way that they are duplicated and later on distributed to other users in the internet or at times even outside of the web. During these instances, the ones who downloaded the said files gain the power to manage the information that they get from the internet. They tend to deal with the matter as a source of personal business. This is called as piracy.

Question is, how does one qualify as an ‘internet pirate’? How do the legal enforcers over the web identify a particular user as a pirate? Would they have any basis in imposing that a person is engaging in acts against the piracy law? Because of the widespread application of the act of peer to peer file sharing in the internet, it is quite hard to pinpoint who is doing what. Notably, it could be understood that it is through this particular reason that the legal sanctions against peer to peer sharing has been established during the recent years. Researchers have found out that with the existence of strict rules, it would be better to contain the situation of piracy that is already considered as a growing commercial plague against the copyright concerns of the artists.

Going Over the Value of Copyright

            In the field of entertainment industry, it could be realized that whatever form of art such as movie, programs and music creations, everything is prepared for and everyone is paid for according to their efforts. Notably, the returns from the sales of such creations are noted as the profit which is specifically considered to be distributed to the individuals who have become a part in the creation of such form of art. When piracy enters the picture, it is most often than not that these artists, producers and manning staffs are affected accordingly. Notably, it could be observed that such situation involves the condition by which the works and efforts of the people involved in the process of creation are being jeopardized.

This is the reason why it was deemed necessary by legal advisers to impose a law called SOPA or the Stop Online Policy Act. This act hopes to control the manner by which files are shared over the internet [no matter what type of files they may be]. The law entails to cease and desist the existence of download nooks that allow internet users that are relatively getting files for their own personal use. The bandwidth used in downloading huge files is then monitored accordingly. Officers in specific areas where the bandwidth founded to be accounted with are then reported to local police officers for confirmation. Once confirmed of the act of piracy, the users are then summoned to report to local police facilities and pay relative amount of damages they are accounted for or if not, they are entailed to serve a specific time of spending months to years in jail.

To make the assumption of legal control more relatively effective, DOJ specifically made it certain that the manipulation of the legal sanctions of the matter be more specific that even online ads are suggested to be barred accordingly. When this happens, the freedom of the people to share files online would be strongly limited. Careful assumption on the part of the users on identifying the files that they are going to share would likely be a certain need to give attention to.

The application of SOPA was a controversial move that received both good and bad reactions from the public. The good reactions specifically came from the industries relatively affected by piracy. The entertainment industry is one of the said factions in the society that gained great benefits from the application of this particular law. The value for their work has been strongly given regard through this law and their rights to property have been protected accordingly. On the other end, a larger number of population of internet users retort against this law showing that they are not sharing files for the sake of piracy but for the sake of personal ownership. Relatively, this is the reason why up to now, the application of SOPA is being strongly debated upon. Notably, such debate causes the condition by which the sanctions of SOPA to be adjusted accordingly. Considerably, the desire to impose the correctness of the law is aimed by the members of the entertainment industry, while its being unjust is strongly imposed by regular users who claim to be not pirating the files.

Conclusion

            The flow of information in the internet has been a strong source of competence in the field of web utilization. Users often define the internet as a bowl of information that could help them with research and simply with the desire of being informed. Sharing files through the web then intends to support this desire through creating a source of information that could be used by the public freely. However, when it comes to the detection on who among the users are utilizing files maliciously, it is important that the manner by which each individual is identified according to the activity they engage with is given consideration to. SOPA or the act against piracy specifically gave way to the possible resolution to the said issue. However, when valued accordingly, it could be realized that the application of such law should be seen through accordingly as it should provide ample balance in seeing the values of P2P sharers and the owners of the files being distributed online.

In the future, more individuals would desire to access files online. Streaming is seen to have a great impact on how human individuals view their favorite programs through the internet. How these files are used are up to the users. Considering ethical conditions of utilizing such files for personal conditions of entertainment should be given careful attention to. All in all, this problem could only be resolved through the utilization and recognition of the value of respect for others’ work, others’ effort and others’ output of talents. The legal sanctions might contain the situation, but it will always be the attitude of humans towards the matter that would provide a long time resolution to the issue at hand.

Mary Cassatt: An American Impressionist Master

According to Nancy M. Mathews, the life and artistry of Mary Cassatt, as compared to that of Degas or Gauguin, was firmly entrenched in all things American, due to being born in the state of Pennsylvania on May 22, 1844. As Mathews describes it, “even though Cassatt left her homeland for Paris, and chose to spend her days in the bohemian world of painters and models, dealers and collectors” in France during the blossoming years of the style known as French Impressionism, there “remained in her the sturdy thread of her ancestry” which dated back to the Revolutionary War when Pennsylvania was a place of “landed gentry and earnest public servants” (3). As proof of this, all one has to do is look at and admire any of Cassatt’s Impressionistic style paintings which although mostly rendered in France still bears the imprint of American culture and tradition.

Watchtower Model

The lead-glazed ceramic model of the watchtower is from the second century A.D. The height of the model is 90 cm with the basin having a diameter of 65 cm. These are measurements of the mother tower, which has a proportion of 1.13 to 1, whereas, for the child tower, the measurements proportion remains the same at 1.11 to 1 (119). From this, it is evident that building measurements vary depending on the grade with constant proportional measurements. The principle behind measurements was carried forth to the treatise of building standards (Yingzao fashi). In the Qin dynasty, Chinese used a considerable standardization of timber due to their building structures of grandiose.

A Comparative Analysis of The Statue of David

Bernini and Michelangelo sculptured the version of David’s. Notable several differences come to the mind of a person when comparing the sculpture of David between Bernini and Michelangelo’s work of art. The differences that are noted are the period, which it was sculptured, the size of the status and the time it was chosen.

Bernini and Michelangelo curved the sculpture of David at different periods and they both used different techniques to portray David as a hero. Bernini and Michelangelo sculptures are based on Biblical scriptures when David was in battle with Goliath. This represents David as a young hero considering he was young during his age. Bernini and Michelangelo have used marble as the construction material and chisel as the curving tool. However all the two sculptures are different from each other? The two sculptures are different in their mode of dressing and they have different postures. The two statues are located at different parts of Italy and the artists made their statues in different heights basing them in different moments of David participating in the battle.

Cross Cultural Study of Dante’s Divine Comedy Representations In Different Cultures

Introduction

This is a case printed in the early 14th century by an Italian politician called Dante Alighieri. The Divine Comedy is the literary reaction by Dante Alighieri to the bitterly contested politics of feudal Florence. Florence was the richest of states in the Italian if not Europe at the time. The region was under two divisions, the black people and the white people. The black people supported the pope while the white people were against the popes verdicts. The then pope, Boniface VII went ahead and schemed with the black people in Florence to seize power over the region in a military coup. This led to the exiling of Dante and by writing his Divine Comedy; he expresses his hatred of the pope and the entire system. The Divine Comedy is Dante’s provocative fictional account of himself having to travel through the three sets of divine realms (Alighieri, 145). They are hell, Purgatory and finally Heaven. He shows in his passage on how tribulations and misinterpretations occur, eliminating his existence in space. As expected, Dante puts his enemies in Hell. He calls this the inferno since it is dense with the corrupt politicians of Florentine. Dante sees them as sinners, thus their position in Hell. The Divine Comedy is not only a means of payback, but it is also the first work of italic poetry, which is not in Latin. The divine Comedy in its original version was in the vernacular, the language of the common people, the language used by the people of Florentine. Date in this perspective goes a long way into stabilizing the Italian language, fomenting new vocabularies, and finally paving the way for a majority of works Witten in the vernacular language (Alighieri 222). He is indeed a lofty Kahuna in the world of poets. His works brought about the influence in the works of Botticelli, William Blake, and Gustav Dore.

Monet: The Houses of Parliament (Effects of Fog)

The Houses of Parliament (Effect of Fog) is the work of art discussed in the following, accompanied by some information regarding the artist.  This oil on canvas painting, housed at the Metropolitan Museum of Art in New York City, was painted in 1903 by Claude Monet and is exemplary of the Impressionist Movement of the era.  The work is actually one in a series of Monet paintings using the Thames River in London as subject (Tucker  258).   The range of Monet’s art exists today, as it did in his own era, to confirm his status as a foremost master of Impressionism, a style that sought to convey an immediate impression of a scene rather than a more realistic or specifically significant representation of meaning (Connolly  6).  Emphasis on lighting, brushstroke techniques, perspective, and use of color are the defining elements of Impressionism and, as will be discussed, Monet’s skill in these renders  The Houses of Parliament (Effects of Fog) an ideal example of the movement.

Wolfflin Principle of Art History

The two painter Botticelli and Credi are linked with each other in a number of factors such as age, period and race, and both of the painters are considered to be the Florentines of the later Quattrocento. Despite their linkage with each other, there are some differences in the art style of both the painters. When Botticelli represents a nude female body, he knowingly or unknowingly relates her physique, body and the shape to the features peculiar to himself. Moreover, the female figures drawn by Botticelli are considered fundamentally and unambiguously dissimilar from that of the nude female bodies of Lorenzo, which were compared to a straight oak from a lime. If observed closely the curve of the arm of the nude figures presented by Botticelli ad Credi, we find quite a bit of peculiar features that can be related to only one of the two painters.

Sandro Botticelli’s The Calumny of Apelles

Rudolph Altrocchi. “The Calumny of Apelles in the Literature of the Quattrocento.” Publications of the Modern Language Association of America, 36, 3, (1921): 454-491.

Altrocchi attempts to determine the possible themes of the painting through a new visitation of classical sources which dated the work and placed it within a larger cultural framework. “Why I Write”

Response to Readings

 

Anne Lamott’s assertion that first drafts are usually “shitty” is an easy statement to agree with. For anyone who has attempted to write meaningfully, the pitfalls of first drafts are abundantly clear. Most people write first drafts that show little of the spark, creativity, logic or even comprehensibility of second or third drafts. Although I personally agree that most first drafts are unrefined and unusable without revision, it is also true that very occasionally a pice of writing, whether an essay, story, or poem will come out on the page in full-form, or nearly full. Even Lamott acknowledges this as a reality and claims to know one or two professional writers who can write excellent first drafts. She mentions, jokingly, that she hates these writers.
